We as Kibo Computer Services Proprietary Limited (“we”, “us”, “Kibo”) are a database administrator. DataGrows is a product of Kibo.

At Kibo, we take online privacy seriously and respect the trust placed in us by our community of users.

This Privacy Policy describes how we collect, use, store, process, and disclose your Personal Information (data that can be used to identify you) when you access, or make use of our platforms, products, services, affiliated sites and applications (“services”) to help you make informed decisions about how you share information when you visit or use the site and any of our applications.

We use your Personal Information to provide and improve our service offering to you. By using our site and any of our applications, you consent to the collection and use of your Personal Information in accordance with this Privacy Policy.

Kibo complies with the provisions of the Protection of Personal Information Act (POPI), 4 of 2013 (“the Act”).

INTERPRETATION AND DEFINITIONS

Interpretation

The words of which the initial letter is capitalised have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

Definitions

For purposes of this Privacy Policy, the following words shall bear the following meanings:

Account means a unique account created for You to access our Service or parts of our Service;

Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority;

Application means any of our software programs provided by the Company and downloaded by You on any electronic device;

Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Kibo Computer Services (Pty) Ltd, 21 Weltevreden rd, Northcliff, Randburg, South Africa 2195;

Country refers to South Africa;

Data Controller, for the purposes of the GDPR (General Data Protection Regulation), refers to the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data;

Device means any device that can access the Service such as a computer, laptop, mobile device or a digital tablet;

Facebook Fan Page is a public profile named “DataGrows” specifically created by the Company on the Facebook social network, accessible from https://www.facebook.com/Data-Grows-103396501876793;

Personal Information means Personal Information as defined in the POPI Act and includes but is not limited to: and to the extent if associated with an identifiable individual: an address, a contact number, a work or personal email address, photos or CCTV, IP address, a web cookie, job title with a name, gender, age, marital status, language spoken; and includes Special Personal Information as defined in the POPI Act and includes but is not limited to: race or ethnic origin, religious or philosophical beliefs, trade union membership, political persuasion, sexual orientation, health records, unproven criminal behaviour, private correspondence, views held by others on the person, biometrics (DNA and fingerprints);

Service refers to any services and applications offered by the Company;

Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used. For the purpose of the GDPR, Service Providers are considered Data Processors;

Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.

Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit);

You means the individual accessing or using the Service, or the Company, site or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

DATA COLLECTING AND PROCESSING

We collect your Personal Information and Special Personal Information for different reasons and we will only use it in accordance with this Policy and the applicable laws. Please ensure that you read this Policy before submitting any Personal Information to us. By submitting Personal Information to us, you consent to the processing thereof in accordance with this Policy.

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic if you agree to our Cookie Policy on the website. Email Marketing

We may use Your Personal Data to contact You with newsletters, marketing or promotional materials and other information that may be of interest to You. You may opt-out of receiving any, or all, of these communications from Us by following the unsubscribe link or instructions provided in any email We send or by contacting Us.

We may use Email Marketing Service Providers to manage and send emails to You.

Payments

We may provide paid products and/or services within the Service. In that case, we may use third-party services for payment processing (e.g. payment processors).

We will not store or collect Your payment card details. That information is provided directly to Our third-party payment processors whose use of Your Personal Information is governed by their Privacy Policy.

These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.

Legal basis for processing Personal Information under the GDPR

We may process Personal Information under the following conditions:

Consent: You have given Your consent for processing Personal Information for one or more specific purposes.

Performance of a contract: Provision of Personal Information is necessary for the performance of an agreement with You and/or for any pre-contractual obligations thereof.

Request access to Your Personal Information. The right to access, update or delete the information We have on You. FACEBOOK FAN PAGE

The Facebook company is now Meta. Their Terms of Use, Data Policy, and Cookie Policy have been updated on their site to reflect the new name on 4 January 2022. While the company name has changed, they continue to offer the same products. Their policies remain in effect and the name change does not affect the use or sharing of data.

Data Controller For The Facebook Fan Page

The Company is the Data Controller of Your Personal Information collected while using the Service. As the operator of the Facebook Fan Page https://www.facebook.com/Data-Grows-103396501876793, the Company and the operator of the social network Facebook are Joint Controllers.

The Company has entered into agreements with Facebook that define the terms for use of the Facebook Fan Page, among other things. These terms are mostly based on the Facebook Terms of Service: https://www.facebook.com/terms.php

Facebook Insights

We use the Facebook Insights function in connection with the operation of the Facebook Fan Page and on the basis of the GDPR, in order to obtain anonymized statistical data about Our users.

For this purpose, Facebook places a Cookie on the device of the user visiting Our Facebook Fan Page. Each Cookie contains a unique identifier code and remains active for a period of two years, except when it is deleted before the end of this period.

Facebook receives, records, and processes the information stored in the Cookie, especially when the user visits the Facebook services, services that are provided by other members of the Facebook Fan Page and services by other companies that use Facebook services.

WHAT WE DO NOT COLLECT

We do not collect sensitive data, such as your race, ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, health data, or sexual orientation.

We also do not knowingly collect personally identifiable information from anyone under the age of 18 years. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Information, please contact Us. If we become aware that We have collected Personal Information from anyone under the age of 18 without verification of parental consent, We take steps to remove that information from Our servers.

DATA TRANSFER

The sharing of Personal Information may necessitate the transfer of user information across foreign borders and in such an event we will comply with the requirements of the applicable jurisdiction and laws in that region.

SECURITY

Kibo takes all reasonable steps to safeguard Personal Information and data from unauthorized access or use, misuse, loss, or interference to ensure the continued integrity and confidentiality of your Personal Information. The same standards are imposed upon third parties to whom your Personal Information is shared by Kibo.

We have implemented security measures to protect the security of your personal data. However, as with any transfer of data, there are still risks of data breaches. We regularly review security and privacy practices to ensure our systems and services are secure. While we cannot guarantee that loss, misuse, or alteration of data will not occur, we use all reasonable efforts to prevent this.

YOUR RIGHTS

The following rights are afforded to you in terms of the protection of the Act and we take all reasonable measures to ensure that:

  • You may request access to your Personal Information;
  • You may withdraw your consent (opt-out) to our use of your Personal Information;
  • You may request to correct or change your Personal Information so that it is accurate and up-to-date;
  • You may request that we limit the processing, sharing or transfer of your Personal Information;
  • You may request that we delete your Personal Information; or
  • Lodge a complaint with us, however, if you are not happy with how we handle the process, you may lodge a complaint with the Information Regulator.

TRANSBORDER FLOW OF INFORMATION

Your information, including Personal Information, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ from those in Your jurisdiction.

We may transfer your Personal Information outside of South Africa to a different jurisdiction depending on the information shared within Kibo. If the transfer of Personal Information and data occurs, we will ensure this is data protected in accordance with this Privacy Policy and in terms of the Data Protection laws in that jurisdiction.

Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.

The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other personal information.

DATA RETENTION
